Employment of our service assume compulsory agreement to our policies and terms of service. Please make sure to read carefully
through the following:
Contract Terms and Acceptable Use Policy
During the application of service with Publisherland.com, including all usage of hosted web service, the Customer must ensure that the
use of any quality web hosting resource offered by Publisherland.com ("Service") conforms with Publisherland.com's Terms of Service Policy (referred to
hereafter as PTS).
Publisherland.com may modify, without prior notice, the PTS as Publisherland.com deems appropriate. Such modified PTS is effective upon posting on
Publisherland.com's website.
Only one host domain name can be utilized, per account. Pointing other domains to your account, or pages within your existing web site is
unacceptable and will be considered grounds for termination, unless you're currently utilizing multiple accounts. Customers exceeding monthly bandwidth
limits will be notified and charged for additional bandwidth usage; excessive or flagrant violation of this term of service will result in termination
of service.
Publisherland's preferred method of payment is credit card. By purchasing our hosting services, you grant Publisherland permission to
charge your credit card for any and all services you request, including, but not limited to, hosting and/or domain name renewals. If we are unable to
process a payment for your hosting plan by its due date, your account will be cancelled for non-payment and related services will be closed to you.
All files and scripts contained within your account will be permanently deleted from the server within five business days, following non-payment by due
date, unless payment is made within that time and accounts suspended for non-payment will only be reactivated upon payment of all overdue fees. If we
make any refunds due to charges you dispute with your credit card company, we will cancel your account. The cancelled account will only be reactivated
once all disputed/refunded fees are resolved satisfactorily, and we receive payment for any and all administrative fees incurred by Publisherland as a
result of your dispute or charge-back request. We cannot guarantee any files or e-mail will be available upon reactivation.
It is a violation of this Agreement for you to misuse or fraudulently use credit cards, charge cards, electronic funds transfers, and/or electronic
checks. A determination of such misuse or fraudulent use shall be in our sole discretion. Further, we may report all such misuses and fraudulent uses
(as determined by us in our sole discretion) to appropriate government authorities, credit reporting services, financial institutions and credit card
companies. In these situations, you shall have waived any and all rights to privacy.
Publisherland reserves the right to refuse any request for registration or renewal of a domain name.
The registration or renewal of any domain name by Publisherland on behalf of a Customer is subject to, and contingent upon:
the Customer providing pertinent information required for completion of the registration,
the availability of the chosen/specified domain name,
the domain name not being in violation of any applicable law, rule, statute or regulation,
the domain name not violating any policies upheld by the Registrar,
all related fees for domain name registration being paid in advance by the Customer and,
the Customer's continued compliance with all Publisherland Terms of Service.
Once a domain name has been registered or renewed through Publisherland, no refunds will be given for the domain registration or renewal
fee. The Customer has full ownership rights over any domain name registered or renewed through Publisherland, where the domain registration fees have been
paid in full by the Customer. In the event of fraud, failure to pay fees, or credit card charge backs, Publisherland will retain possession of the domain
name. Publisherland is not responsible for maintaining the registrant information for domain names. The domain owner will be made aware of options for
maintaining and updating this information. The registrant may contact Publisherland's customer service team for inquiries regarding this. Updating your
information with Publisherland does not automatically update it with the Chosen Registrar.
Publisherland is not responsible for any domain name's availability. The Customer waives any and all claims against Publisherland for,
and hereby releases Publisherland from, any loss, damage, liability, cost or expense arising out of, or relating to, the registration or release of a
domain name. The Customer acknowledges and understands that any and all domain name registrations or renewals are subject to the policies, regulations
and applicable laws of ICANN (Internet Corporation for Assigned Names and Numbers). In addition, any and all domain name registrations and renewals are
subject to the terms and conditions of the Chosen Registrar, which can be found on the Web Site of the Chosen Registrar. Upon request, Publisherland
will provide the Customer with the name of the Chosen Registrar.
The Customer understands and accepts that a request for a domain name registration or renewal does not guarantee it's registration. The
Customer understands and accepts all risks associated with the Internet and e-commerce in general. The Customer waives any and all claims it may have
against Publisherland for, and hereby releases Publisherland from, any loss, damage, liability, cost or expense arising out of, or relating to, the
registration or release of a domain name in such circumstances. Publisherland is not liable for domain disputes that may arise over changed registrant
information for a domain name, nor is Publisherland responsible for resolving any domain disputes. These issues must be resolved by the involved
parties, according to the legal bounds of ICANN. Publisherland will not act as an arbitrator, but will honor any ICANN decisions. If we are unable to
secure payment before the domain renewal date, the domain name will expire. Forty (40) days after a domain renewal date, a domain name will be released
by the Registrar and made available to the general public for re-registration. After a domain has expired, we will, upon a Customer's request, put in a
request with our Registrar to renew and reactivate the domain name if all registration fees are paid (including any extra fees required to pull a domain
name out of its redemption period).
The Customer agrees that any and all information provided in connection with any domain renewal request shall be factual and correct in
all respects. With regard to such request, Publisherland assumes responsibility only for processing the request with the Chosen Registrar. Publisherland
disclaims any and all responsibility to verify any information provided in connection with the request and shall have no responsibility or liability for
any loss, delay, inconvenience, interruption in service, service error or loss of data. Publisherland bears no responsibility or obligation to notify
Customer of any approaching domain name expiration dates. The Customer agrees to bear complete responsibility for tending to any time sensitivity issues
regarding the domain name.
Violation of this web hosting agreement (the PTS) may subject Customer to international, federal, and/or state civil and/or criminal
liability. Publisherland.com reserves the sole right to suspend or terminate a Customer's access to the Service at any time for violating the PTS.
Publisherland.com also reserves the right to suspend, filter or block, and/or terminate Customer's access if Customer's account is being used to exploit
or attack the Service or the networks of others. A Customer's account which has been compromised and/or poses a threat to the security and general
welfare of this service, accompanying technologies, or other individual entities on the web is subject to immediate suspension or termination of service
by Publisherland.com. If Customer's access is suspended or terminated, Publisherland.com, in its sole discretion, may refuse to accept all new e-mail
sent to the terminated e-mail address and delete Customer's data stored on Service. Publisherland.com will fully cooperate with law enforcement
authorities in the detection and prosecution of illegal activity.
The Customer is responsible for protecting passwords and for any authorized or unauthorized use.
Sites may not use extreme unwarranted CPU usage. This includes usage of scripts or files that use a large stream opf bandwidth/transfer
or require heavy CPU usage in order to load or implement. Any scripts or applications causing a burden on server capacity or activity must be removed
upon request by Publisherland.com. It is the sole discretion of Publisherland.com top determine what kind of scripts or applications consititue
unwarranted CPU usage.
Customers may not use disk space as a file repository. If a customer exceeds the storage space specified in the hosting packaged, the account may be
terminated.
Customer may not resell the Service or any portion of it. This includes disk space or available email utilities.
Nor may Customers use accounts to park domains. You must have an actual website to go with each domain name.
All content appearing on Customer websites is assumed to be the discretionary property of the customer by Publisherland.com. By utilizing
services provided by Publisherland.com, Customer assumes all responsiblility for ALL content or information residing on, obtained or transmitted via the
Service, regardless of whether such use is by Customer. Any damaging or liable statements issued from the customer's website or illegally dissemninated
material is the onus of the customer who will assume full liability for any actions persuant to said content. Publisherland.com assumes no liability for
damaging, false or slanderous content manifest on customer websites.
By utilizing services provided by Publisherland.com, the Customer is under compulsory agreement to provide appropriate protection to
prevent minors (persons under 18 years of age) from accessing any unsuitable material that Customer publishes via any Service.
Violation of the following rules will result in termination of your account without refund:
Publisherland does not condone and will not permit the following actions:
Distribution or display of obscene exploitation of children and child pornography or linkage to sites which contain such content.
Publisherland.com will assist law enforcement authorities in any such prosecution of illegal activities.
Intellectual Property Infringement or Distribution of any materials not the sole Intellectual Property of the owner not permitted by license.
Customer may not with out permission have sound/video files in any format (MP3, ASX, ASF, RA, RAM , QTV etc.) due to the high rate of illegal
transfer of copy written material.
Mass mailing of unsolicited commercial materials. Customers may not send any mass mail materials which have not been requested by the recipient,
through agreements to join mailing lists or similar requests. Publisherland.com reserves the right to determine the nature of such outgoing
material and it is compulsory for the owner to provide documented requests for all such recipient data. Customers may not send bulk email of
any type other than email to their own subscribers. Safelists or any other rented or purchased lists are not allowed. The email subscriber must
have joined your list from your site. Should a complaint be levied against the customer in any way which may be deemed pursuant to this rule,
the Customer's account will be immediately terminated.
Relaying emails from a third party which can be construed as mass email or pose security risks to other entities.
Using the web service to defraud others in any way; including false identification, pyramidal marketing, provision of fraudulent services or
data, or "bait and switch" selling of any kind.
The deliberate transmission of computer viruses, worms or trojan software. Any attempt to use the web service in order to intentionally damage,
derail or debilitate the integrity of other entities' physical or virtual properties (including email, websites or web services) is subject to
termination and criminal prosecution. You are in no way allowed to use the Service to attempt to gain unauthorized entry to any site or network
or to gather information from others without their expressed permission. Attempts at using the service in connection with accessing secure
areas of the web with malicious or criminal intent is subject to immediate termination and criminal prosecution. Publisherland.com will assist
law enforcement authorities in any such prosecution of illegal activities.
Publisherland will not permit live video, webcam or audio feeds on your site.
Limitation of Liability:
Publisherland.com shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise
from servers going off-line or being unavailable for any reason whatsoever. Further, Publisherland.com shall not be responsible for any claimed damages,
including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Publisherland.com servers. All
damages shall be limited to the immediate termination of service.
Publisherland.com shall be the sole arbiter of what is and is not a violation of these acceptable use policies. Publisherland.com
reserves the right to terminate an account at any time and for any reason that causes harm to any customer's web sites. Publisherland.com reserves
the right to delete all content and files upon termination. Publisherland.com reserves the right to withhold any pre-paid funds for any site removed for
violations of these policies. Publisherland.com reserves the right to refuse, cancel, or suspend service at our sole discretion.
Publisherland.com reserves the right to change these Policies without prior notice or warning. Non-enforcement of any part of these
Policies does not constitute consent.
